律师取4万元遭银行“盘问”，反诈如何破解“误伤”难题？

　　1月30日，当事律师周筱赟通过其微信公众号发布消息，他已正式起诉中国建设银行东营东城支行（以下简称东营建行）。该案已经正式立案，东营经济开发区人民法院向其发放了正式的受理案件通知书，案号为（2026）鲁0591民初231号。

　　周筱赟表示，建行总行的内部线人告知，这次不是由东营建行派员出庭，而是由北京的建行总行派出团队。

　　回溯案件起因，去年11月3日，周筱赟在山东东营出差期间，前往中国建设银行东营支行提取4万元现金时，被告知取款一万元以上需要进行登记，柜员进一步追问资金具体用途，甚至调取其一个月前的交易流水，询问某笔转账的细节。

　　在周筱赟拒绝透露更多私人信息后，银行报警。半小时后，银行方面又称无法联系到警方，并突然转变态度表示可以办理取款业务。最终，周筱赟放弃取款。

　　周筱赟表示：“反诈的初衷是好的，也是很有必要的，但是各级基层的银行不能对反诈层层加码，故意折腾普通老百姓和银行柜员。这种做法不仅侵犯了客户的隐私权，而且是把所有的客户当成犯罪嫌疑人来审问，所以我决定不再配合他们，我放弃了取款。”

　　今年1月30日，周筱赟表示，此次起诉东营建行，他没有提出经济赔偿的要求。其诉求有两个：一是请法院确认东营建行侵权的事实，二是要求东营建行在全国性媒体公开赔礼道歉。

　　周筱赟补充说，希望通过起诉东营建行，促进建行以及其他所有商业银行，尽快落实央行新规，不要再玩“无感询问”、“非对抗性话术”之类的文字游戏。

　　周筱赟表示：“希望通过起诉东营建行，推动银行管理层正视过度反诈的问题，让建行的管理层有一点点警醒，推动一点点变革。而不是折腾普通老百姓，也折腾银行柜员。一旦发生纠纷，又让柜员来背锅。如果一家银行改变了，其他银行也会跟进。”

　　2025年11月，事件登上热搜后次日，建设银行东营分行副行长侯新和发信息向周筱赟道歉，但被拒绝。

　　周筱赟解释说，这份道歉中，仅对“体验不佳”深表歉意，而不是为建行“层层加码”的行为道歉。

　　周筱赟将“体验不佳”解读为“作为储户太过敏感”的意思，或者“柜员理解有误、态度不好”的意思。周筱赟认为，这种表述会把责任推给他自己或者柜员。

　　周筱赟声明：他从未投诉建设银行东营东城支行当天的柜员，也不会投诉该柜员。因为这名柜员只是执行者。

　　层层加码的过度执行和“一刀切”简单化处理现象，让一些群众因反诈“误伤”而徒增不便。

　　事件发酵后，周筱赟表示，他收到了很多网友的鼓励和支持，也有银行柜员向他倾诉反诈执行中遇到的困境。据反映，有些地方甚至取现5000元就需要向银行方面进行登记。

　　周筱赟引述中国人民银行等2022年出台的《金融机构客户尽职调查和客户身份资料及交易记录保存管理办法》规定，个人办理单笔5万元以上现金存取业务需“了解并登记资金来源或用途”。

　　他表示，规定中明确的金额标准为5万元，但正如他此次遭遇的，有的地方银行“自行加码”，将标准降低到1万元。

　　公安部2025年6月公布的一项数据显示，2024年以来，国家反诈中心下发资金预警指令180多万条，紧急拦截的涉案资金超过3000亿元，形成了齐抓共管、群防群治的整体合力，有力维护了人民群众财产安全和合法权益。

　　专家表示，在肯定反诈工作成效的同时，近期发生的多起“误伤”事件也折射出执行层面的一些问题。

　　人民日报评论说，这些现象的产生，根源在于一些地方和机构为规避自身风险，将反诈防控的责任简单化地转嫁给群众，暴露出“懒政”思维。其本质是政策执行的变形走样，以“一刀切”的粗放管理替代本应精准施策的治理能力，不仅模糊了必要的权责边界，还导致反诈的初衷在一定程度上异化为对群众权益的妨碍。

　　2025年8月，中国人民银行、国家金融监督管理总局、中国证监会联合发布了《金融机构客户尽职调查和客户身份资料及交易记录保存管理办法（征求意见稿）》。

　　与2022年的版本相比，这份新规中最引人注目的变化是：取消了2022年版监管规则中关于个人办理单笔5万元以上现金存取业务需“了解并登记资金来源或用途”的硬性要求。

　　2025年11月28日，央行网站正式发布更新后的《金融机构客户尽职调查和客户身份资料及交易记录保存管理办法》，自2026年1月1日起施行。

　　周筱赟肯定了这份新规，同时补充说，应当通过大数据+AI来精准判别异常交易，而不是让柜员凭感觉。只要经办柜员做到了风险提醒+异常报备，哪怕以后这张银行卡涉诈，也不应当处罚柜员。

　　他希望尽快废除对银行柜员不合理的处罚制度，不要再让柜员为管理层的错误来“背锅”。柜员不是侦探，不可能在短短几分钟内就作出精准判断。
